OPEN MEETING:
Chair B. Sadow opened the November 4, 2009 Planning Commission meeting with a salute to the flag at 7:30 PM.
APPROVAL OF MINUTES:
A motion was made by T. Keebler, seconded by C. Hall, to approve the minutes of the October 6, 2009 PC meeting with the following change. The vote of the motion under New Business should read: The motion carried 5-0-2 with C. Hall and B. Sadow abstaining.
SUBDIVISIONS:Erhardt & Spadaccino – Lot Line Adjustment
TMP# 30-8-125-001 – 448 Center Hill Road
Wynn Review Letter dated: 10/30/2009
-The applicant was not in attendance. The Planners and S. Baluh reviewed the Wynn Associates letter of October 28, 2009.
Item #1: Area within the right-of-way has been dedicated to the Township.
Item #2 & 3: A waiver letter should be sent by the applicant for the Environmental and Cultural Impact Assessment Report, street improvements, including cartway widening, curb and sidewalks.
Item #4: Installation of property monumentation prior to plan recordation.
Item #5: A deed of consolidation should be recorded at the time of plan recordation
A motion was made by D. Haubert, seconded by T. Keebler, to approve the Erhardt & Spadiccino lot line adjustments upon the condition that the applicant file a waiver request letter and meet the conditions of the Wynn Assoc letter of October 28, 2009 prior to approval of the plan. The motion carried 6-0-0.
OLD BUSINESS: Proposed Wind Energy Systems Ordinance
BCPC review letter dated: 10/5/2009 – for Discussion
-S. Baluh commented that changes were made to the proposed ordinance and the B.C. Planning Commission recommended that they be allowed in all districts and not restricted only to single family homes. M. Kulp noted that they be allowed as long as the height requirement and structural development is maintained. S. Baluh and the Planners discussed and they recommended changes to #1 under Section 234-24 that it should reflect it has to be an accessory to any principal use. They also recommended adoption by the Board of Supervisors. A motion was made by M. Kulp, seconded by T. Keebler, to recommend that the proposed amendment to the zoning ordinance, Wind Energy System, with the stipulation that the use regulations should allow use in all zoning districts but only as an accessory item to the primary residence or business on the property. The motion carried 6-0-0.
PUBLIC COMMENT: There was no public comment.
CORRESPONDENCE:
C. Gouck Subdivision – Board of Supervisors Preliminary Approval 10/28/2009
A motion was made by M. Kulp, seconded by T. Keebler, to authorize the Chairman of the Planning Commission, B. Sadow, to sign the Planning Module for the Gouck Subdivision. The motion carried 6-0-0.
-A. Eichlin commented that a request for extension was sent to Wm. Benner for the Nockamixon Crossing Shopping Center. There has been no response.
A motion was made by C. Hall, seconded by M. Kulp, to recommend that the Board of Supervisors deny the Nockamixon Crossing Shopping Center Plan if an extension is not received by the November 18, 2009 Board of Supervisors meeting.
The motion carried 6-0-0.
Kerl Subdivision plans were available for signature by the Planners.

A motion was made by D. Haubert, seconded by C. Hall, to adjourn the Planning Commission meeting at 7:59 PM. The motion carried 6-0-0.
