OPEN MEETING: Chair B. Sadow opened the October 6, 2009 Planning Commission with a salute to the flag at 7:30 PM.
APPROVAL OF MINUTES: A motion was made by T. Keebler, seconded by P. Hamilton, to approve the minutes of the August 4, 2009 PC meeting with the following corrections: Under Members Absent replace Andrew Schad with Christopher Hall; under Minutes Approval, replace C. Hall with P. Hamilton. A. Schad abstained. The motion carried 4-0-2.
SUBDIVISIONS:Patricia & John Gouck, 2-Lot Subdivision, Revised Plans TMP# 30-3-4-1 – 979 Haycock Run Road Waivers 8/28/2009; BCCD App & Submission Letter 8/28/2009; Revised SW Mgmt 8/26/2009 & Revised Env. & Cultural Impact Assessment 8/28/2009 Wynn Review Letter dated: 9/25/2009
Paul Dietz, Urwiler and Walter, presented for the applicants Patricia & John Gouck, who were also present. Mr. Jensen reviewed the 9/25/2009 Township Engineer’s review letter. #1 Will Comply: The development restriction referencing the previous subdivision has been noted on the plan. #2 Will Comply: The applicant is offering a fee in lieu of 10 percent of ground dedication. #3 Waivers: #4 EAC Will Comply: The applicant will respond to the EAC report between preliminary/ final approval if there is an issue. #5 Will Comply: The right of way matches dedication from previous subdivision. #6 Will Comply: Stormwater management. A narrative will be added to the Stormwater Report. #7 Will Comply: Applicant has the approval letter from Bucks County Conservation district. #8 Will Comply: Proposed well. The well needs to be drilled before final approval. S. Baluh noted that the applicant needs to get a permit from both the County and the Township. #9 Will Comply: Plans were submitted to the Fire Company. Applicant to supply Commission with documentation that plans have been submitted to Fire Company. #10 Will Comply: Sewage Facilities Planning Modules have been submitted to Township and the Health Department. S. Baluh noted the Township needs an O & M agreement. #11 Will Comply: Driveway entrance plans have changed to not include a shared driveway with the neighbor. The plan shows that the culvert pipe along Haycock Run Road will be continuous for both driveways. #12 Will Comply: Property monumentation. #13 Will Comply: Standard development agreement. #14 Will Comply: Additional comments generated by resolution of above items.
A motion was made by T. Keebler, seconded by C. Hall, to grant preliminary plan approval on minor subdivision TMP#30-3-4-1 based on the conditions listed in the 9/25/2009 Township Engineer’s review letter and the Princeton Hydro Report. The motion carried 7-0-0.
A motion was made by M. Kulp, seconded by T. Keebler, to recommend granting the waivers on the Gouck Subdivision TMP#30-3-4-1: Section 196-403.4 Contour lines; Section 196-506.4.A Cartway Width; Section 196-512 Curbs; Section 196-513 Sidewalks; Section 196-526 Lighting; Section 196-409 Wetlands Delineation; Section 305.C from the Stormwater Management Ordinance, existing impervious surface calculations. The motion carried 7-0-0.
Beatriz Erhardt - Lot Line Adjustment TMP# 30-8-125-001 – 448 Center Hill Road Wynn letter dated 9/24/2009
Paul Dietz, Urwiler and Walter, presented for the applicant, Beatriz Erhardt, who was also present.
P. Dietz explained that the record plan completed in 2004 on the Erhardt property was submitted with a revised subdivision plan allowing adding 3 acres to the lot. S. Baluh recommended resubmitting as a lot line change because the lots are now in different ownership. In conclusion the Commission’s recommendation was for the applicant to submit a plan involving only lots 1 and 2. Approval would be conditional upon following though with the property transfer.
LAND DEVELOPMENT :
NEW BUSINESS:Change November 3, 2009 Meeting Date. Because November 3 is Election Day, the Planning Commission’s regular meeting will be changed to November 4, 2009 7:30 p.m. The date change will need to be advertised.
A motion was made by C. Hall, seconded by T. Keebler, to change the November 3, 2009 to November 4, 2009 7:30 p.m. and give permission to the Township Secretary to advertise the change. The motion carried 5-0-2 with C. Hall and B. Sadow abstaining.
OLD BUSINESS: Proposed Revisions to Wind Energy Systems Ordinance Wynn Letter dated 9/8/2009 – S. Baluh explained that the changes have been sent to the County. When the County review letter comes back, any final changes can be made to the Board of Supervisors.
PUBLIC COMMENT: Todd Stone announced that the Gallows Run Water Association and DCNR will be having a stream cleanup on Oct 24 th. T. Stone suggested having a workshop with neighboring townships to learn about Springfield’s Stormwater Ordinance update. S. Baluh explained the changes on the Act 537 Plan from the DRBC will be sent to the County, Health Department and Planning Commission.

ADJOURNMENT: A motion was made by A. Schad, seconded by T. Keebler, to adjourn the Planning Commission meeting at 8:15 PM. The motion carried 7-0-0.
