OPEN MEETING:

Chair B. Sadow opened the May 5, 2009 Planning Commission with a salute to the flag at 7:30 PM.

 

APPROVAL OF MINUTES:

A motion was made by D. Haubert, seconded by P. Hamilton, to approve the minutes of the April 7, 2009 Planning Commission meeting as presented. M. Kulp abstained. The motion carried 6-0-1.

 

CONDITIONAL USE: Thomas & Ann Lyons – T-Mobile Northeast, LLC

TMP #30-8-50 Additional Antenna to existing Cell Tower

Wynn Review Letter of 4/29/2009

 

Bill Benner presented for the applicant. The application proposes the mounting of the T-Mobile antennas with a 10x20 concrete pad upon the existing communication tower on the Lyons property.

 

A motion was made by M. Kulp, seconded by T. Keebler, to recommend to the Board of Supervisors to add the tower and pad with the associated equipment conditional upon the items listed in the 4/29/2009 Township Engineer’s review letter. The motion carried 7-0-0.

 

 

Vincent W. Fleck – T-Mobile Northeast, LLC

TMP# 30-8-103 – Additional Antenna to existing Cell Tower

Bill Benner presented for the applicant. T-Mobile proposes to mount its towers at the 150 foot level. T-Mobile is waiting for the structural reports to come in.

 

A motion was made by D. Haubert, seconded by T. Keebler, to recommend to the Board of Supervisors an extension conditional upon receipt of the structural report before the next Board of Supervisors meeting. The motion carried 7-0-0.

 

 

SUBDIVISIONS:Anne Marie Morton 3-Lot Subdivision – Revised Plan

TMP #30-13-5 – Lonely Cottage Road – Residential Zoning;

Steve Jensen presented for the applicant. Mr. Jensen reviewed the February 15, 2009 Township Engineer’s review letter.

#1 Waiver : waiver for recreational lands – applicant agrees to fee in lieu of.

#2 Waiver: waiver for road improvements - The consensus of the Commission is that the road along the property will need to be widened to 18 feet. S. Baluh will confirm the desirable width, and the applicant will be responsible for the widening of the road.

#3 Waiver: Curbs and sidewalks will be waived.

#4 EAC: Applicant to provide updated environment impact report that will be sent to the EAC.

#5 Will Comply: Right of way – Legal descriptions have been submitted.

#7 Will Comply: Storm water management – existing pond on site to be used.

#8 Forthcoming: Position of wells.

#9 Forthcoming: Plans to be submitted to the fire company.

#10 Will Comply: Sewage facility planning modules.

#12 Will Comply: Existing overhead utilities – an easement for the utilities was created between Lots 2 and 3.

#13 Will Comply: Financial security agreement and opinion of cost.

The general consensus of the Commission is that the plan’s concept is good but needs to be refined, in particular the road widening issue.

 

 

Christman Tract Subdivision – For Discussion

Fox Rothschild LLP – Corr dated 2/25 & 4/22/2009

 

Dwayne Gross presented for the applicant. Mr. Gross presented his sketch plans to the Commission. There was a lengthy discussion regarding open space on the plan. Mr. Haubert stated that emergency access needs to be addressed and the applicant also needs to address the open space issue before the plan can move forward. Applicant needs to return with a formal plan, and the Commission is comfortable with the basic concept of the plan.

 

 

 

LAND DEVELOPMENT: DiPalantino Land Development – Revised Plan

TMP# 30-11-83 – Easton Road – Industrial Zoning;

P-Hydro Review dated 3/6/2009; EAC review dated 3/10/2009;

Steve Jensen presented for the applicant. Mr. Jensen reviewed the Township Engineer’s review letter.

#1 Will Comply: Reduced buffer yards.

#2 Forthcoming: Cultural and environmental impact assessments have been submitted with the plan.

#4 Will Comply: waiver for curbs and sidewalks.

#5 Forthcoming: PennDOT permit.

#7 Will Comply: Maintenance agreement

#8 Will Comply: Conservation district approval.

#9 Will Comply: On-site well testing.

#10 Will Comply: Plan to be sent to the fire company.

#11 Will Comply: Holding tank for sewage disposal.

#12 Will Comply: A light will be put back in the right of way.

#14 Forthcoming: Dedication of easement and right-of-way.

#16 Will Comply: Certification on record plan.

 

The general consensus of the Commission is that the storm water issue must be settled before the plan can go any further.

 

Palisades High School – Discussion – Request for Waiver

TMP #30-4-61 & 61-1

 

Scott McMackin presented for the applicant. Mr. McMackin explained that there will be a new building constructed and minor expansion of the parking area and they are seeking a land development waiver. The general consensus of the Commission is that they would like to see a complete land development submitted.

 

OLD BUSINESS: Review Wind Energy Systems Amendment - tabled
