OPEN MEETING: Chair B. Sadow opened the March 3, 2009 Planning Commission with a salute to the flag at 7:30 PM.
APPROVAL OF MINUTES: A motion was made by M. Kulp, seconded by C. Hall, to approve the minutes of the February 3, 2009 PC meeting as corrected, with B. Sadow abstaining. The motion carried 5-0-0.
NEW BUSINESS:Smeland Tract; Lot Line Adjustment TMP# 30-15-23-1 & 30-15-22 Wynn Review dated 2/19/2009
Jason Smeland, Lenape Valley Engineering was in attendance. J. Smeland reviewed the Wynn Associates Review letter of February 19. 2009. #1 Will Comply: Identification of proposed lot line adjustment with respect to future access. #2 Will Comply: Identification of ultimate right of way on Quarry Road along frontage of the Furhman property. #3 Will Comply: Zoning data for RZ District must be revised to reflect the minimum lot area of 2 acres. #4 Will Comply: Lot areas must be revised to be consistent and net lot area should deduct the utility easement and street right of way. #5 Will Comply: Design engineer to verify impervious surface coverage on Lots 1 and 2 is based on net buildable site area. #6 Waiver Request: Environmental & Cultural Impact Assessment Report submission. #7 Waiver Request: Street improvements including cartway widening, curb and sidewalk installation. #8 Waiver Request: Right of way dedication along the frontage of the Furhman property. #9 Will Comply: Property monumentation along lot line and Furhman property must be indentified on plan. #10 Will Comply: Township Engineer signature line should be removed from record plan.
A motion was made by M. Kulp, seconded by T. Keebler, to approve the waivers requested in the February 19, 2009 Township Engineer’s review letter with the condition a request for waivers for right of way and the dedication of Quarry Road. The motion carried 5-0-0.
Cobbler Road LP Subdivision; Preliminary TMP# 30-11-105 Wynn Review dated 2/26/2009
Bob Harrington, HMH Limited; Robert Gundlach, Fox & Rothschild and Amy Magers were present. R. Gundlach presented the preliminary plan. #1 Will Comply: Area within the ultimate right of way of Route 611 will be accepted as an easement. #2 Will Comply: Buildings on Lot 1 are existing nonconforming with respect to yard setbacks and encroachment into environmental features. #3 Waiver Request: R. Gundlach inquired about identification of the buffer yard between the auto repair facility and adjoining residential properties. #4 Will Comply: Environmental Impact Statement must be revised to be consistent with the amended lot layout. Comments regarding floodplain/wetland disturbance must be addressed. #5 Forthcoming: The applicant proposes a fee in lieu of area to be dedicated for recreational purposes. This will be reviewed by the Park and Recreation Committee and the Commission. #6 Forthcoming: Proposed access and utility construction to the onsite sewage disposal system must be included on the plan and address proposed wetland/watercourse crossing. R. Gundlach stated that the applicant will replace system if the Bucks County Health Department requires it. #7 Will Comply: Well on Lot 1 must be plugged and be indicated on plan. New well must be installed on Lot 3. #8 Will Comply: Applicant agreed to installation of 6 foot wide shoulder. #9 Will Comply: Maintenance agreement must be prepared and legal description for shared driveway easement must be submitted. #10 Will Comply: Enlarged details of proposed shared driveway access must be included on plan. #11 Waiver Request: Related to lot configuration, sidewalk and stormwater management basin design. (partial) #12 Will Comply: Applicant will add additional landscaping to the plan. #13 Will Comply: Stormwater Management Calculation comments A through F. #14 Will Comply: Erosion and sedimentation control measures and NPDES permit must be obtained. #15 Will Comply: Monumentation must be installed. #16 Will Comply: Applicant will install street lighting at shared driveway, and keep the light at Route 611 on post. A light at the end of individual driveways would be allowed, as long as it meets the township’s light ordinance. #17 Will Comply: Development/Financial Security Agreement to be executed and an opinion of cost to be submitted. #18 Will Comply: A comprehensive review of drafting details is deferred until plan modifications are submitted.
The Commission is ok with the waivers except for as listed in Item 3. The applicant will be revising and resubmitting plans.
OLD BUSINESS: Review Proposed Act 537 Update – Set Dates
The Commission will meet on the 3 rd Thursday in April from 7:00 to 9:00 p.m.
PUBLIC COMMENT: There was a discussion with a Haycock Run Road resident regarding a shared driveway with a neighbor’s proposed subdivision.
