ROLL CALL:
Members Absent: Mark Kulp OPEN MEETING: Chair B. Sadow opened the December 2, 2008 Planning Commission with a salute to the flag at 7:30 PM.
APPROVAL OF MINUTES: A motion was made by D. Haubert, seconded by T. Keebler, to approve the minutes of the November 5, 2008 PC meeting as presented. The motion carried 5-0-0.
-C. Bahnck arrived at 7:40PM after approval of the minutes.
SUBDIVISIONS:Guy Jesiolowski – 2-Lot Subdivision – Final Plan TMP# 30-15-11-4; Residential Zoning Wynn Review Letter – 11/25/08 E. Pellegrino, Urwiler & Walter, and the applicant G. Jesiolowski were in attendance. E. Pellegrino, S. Baluh and the Planners reviewed the Wynn Associates Review letter of November 25, 2008. #1 Forthcoming: The A.C. of Engineers found no delineated wetlands on the property and a jurisdictional determination will be forthcoming. #2 Will Comply: The applicant will pay a fee in-lieu-of recreational land in the amount of $3,000.00 per new lot. #3 Waiver: A fee in-lieu-of $3,000.00 per new building lot will be paid upon granting waivers for street improvements. #5 Will Comply: Offer the ultimate right-of-way of Quarry Road for dedication to the Township. No legal descriptions have been received by the Township at this time. #6 In process: S. Baluh commented that the only item that needs to be addressed is the maintenance program to include in the O&M agreement. #7 Received: Approval letter has been received from the B.C. Conservation District. #8 Will Comply: Well has been installed on Lot #2. A retest will be completed due to findings of coliform and arsenic. S. Baluh commented that a pump test is also required. Applicant will provide results to the Township. #10 In process: The applicant spoke with J. Yeager, the Township Solicitor, who expects the Planning Module to be completed and ready for signature shortly. #11 Will Comply: Property monumentation will be installed. #12 Will Comply: A Development/Financial Security Agreement will be executed between the applicant and the Township. The applicant has several items to complete. A motion was made by T. Keebler, seconded by P. Hamilton, to grant the G. Jesiolowski Minor Subdivision on Quarry Road TMP# 30-15-11-4 final approval upon compliance with the pump test, obtains Planning Modules and meets all requirements in the Wynn Associates Review Letter of November 25, 2008. The motion carried 6-0-0.
LAND DEVELOPMENT: Glenn Neebe – Harrow Station Senior Housing Revised Plans – TMP# 30-11-30-7, SR412 SW & Erosion Control Narrative – 10/14/2008 Narrative Summary 10/14/2008 Wynn Review Letter – 11/25/08 E. Pellegrino, Urwiler & Walter, and the applicant, G. Neebe, were in attendance. E. Pellegrino, S. Baluh and the Planners reviewed the Wynn Associates letter of November 25, 2008. #1 Conditional Use Hearing: Because of the amount of time since the Conditional Use Hearing, S. Baluh reviewed the Conditional Uses for the Harrow Station Senior Housing L/D. Some of the decisions discussed were: #4. heavier buffering with shrubs between St. John’s and Senior Housing. The Planners suggested more shrubs in the area of the Senior Housing Units. The applicant agreed. #9. A sidewalk from the Church parking lot to the restaurant and the shopping center. After a short discussion, the applicant commented that he did not want to run sidewalks along the parking lot for the restaurant. A pathway connection from the church parking lot to the units was suggested. G. Neebe will contact the church for their opinion. #2 Will Comply: The applicant will discuss the number of parking spaces at the existing daycare with the owner. #3 Will Comply: A PennDOT HOP will be obtained by the applicant. #4 Will Comply: The fire company will be contacted with regard to the width of the walking path to allow for emergency access. The applicant will follow their recommendations. #5 Will Comply: Design details for the utility crossings will be included and the appropriate permits will be obtained from the State or the A.C. of Engineers. #7 Clarify: the size of the truck will be indicated on the turning radius shown on the plans. The applicant is trying not to cover any more of the surface with blacktop, would like to keep grass cover. #8 Will Comply: Landscaping was discussed earlier. #9 Will Comply: In order to control stormwater, a concrete vault is proposed for the underground detention facility. S. Baluh suggested constructing a temporary sediment basin during construction. E. Pellegrino will discuss with the applicant. Operation & Maintenance agreement will be executed between the applicant and Township. #10 Will Comply: Will obtain an NPDES permit from the B.C. Conservation District. #11 Will Comply: The existing well will be retested. There is an additional well on site, no back up well is required. S. Baluh commented that water storage will be needed for the residential properties. #12 Will Comply: Servicing fire company will be contacted for their comments. #13 Modified Agreement: The proposed sanitary sewer collection systems will be separate from the other projects at the Harrow Station. Planning modules to be prepared and sent to B.C. Department of Health, Nockamixon Township and PADEP for approval. S. Baluh recommended another meeting with Clinton Cleaver to confirm that permits will be issued by PADEP. #14 Will Comply: Identify all utility easements and right-of-ways on the record plan. #15 Will Comply: Additional lighting is proposed for the site entrance at SR412. #16 Will Comply: E. Pellegrino commented that this plan has a number of changes and it may affect the comments of the EAC and P-Hydro. A written response will be prepared advising of the updates to the plan. #17 Will Comply: Development/Financial Security Agreements will be executed between the Township and the applicant. #18 Will Comply: General engineering/drafting details of the plan. The applicant requested preliminary/conditional approval of the plan in order to move forward with submitting and obtaining the PennDOT HOP and the PADEP permits. S. Baluh suggested that the applicant clean up as many items as possible prior to preliminary approval. If the applicant wants to submit paperwork to PennDOT, he will write a letter from the Township. G. Neebe commented that he would review this matter. A motion was made by T. Keebler, seconded by C. Bahnck, to authorize S. Baluh of Wynn Associates to write a letter of recommendation for Harrow Station LLC Senior Housing, TMP# 30-11-30-7 & -30-3 in order for the applicant to obtain his PennDOT Highway Occupancy Permit. The motion carried 6-0-0.
NEW BUSINESS:Advertise for Planning Commission Reorganization – January 6, 2009 A motion was made by T. Keebler, seconded by P. Hamilton, to direct the Planning Commission Secretary to advertise for the Planning Commission Reorganization for January 6, 2009. The motion carried 6-0-0.
Prepare Year-End Report (2008) Motion to approve A motion was made by T. Keebler, seconded by P. Hamilton, to direct the Planning Commission Secretary to prepare the Year-End Report for 2008. The motion carried 6-0-0. OLD BUSINESS: There was no old business.
PUBLIC COMMENT: -D. Haubert commented that he would like to make a recommendation from the Planning Commission to the Board of Supervisors to discuss waiving fees for Minor Subdivisions between family members and consider waiving fees for those residents who donate land.
CORRESPONDENCE:
A motion was made by B. Sadow, seconded by D. Haubert, for a conditional denial to the Christman Tract Subdivision if no extension request is received prior to the November Board of Supervisors meeting. The motion carried 6-0-0.
ADJOURNMENT: A motion was made by C. Bahnck, seconded by T. Keebler, to adjourn the Planning Commission meeting at 8:55PM. The motion carried 6-0-0.
