MINUTES

OPEN MEETING:

Chair B. Sadow opened the July 1, 2008 Planning Commission with a salute to the flag at 7:35 PM.

 

APPROVAL OF MINUTES:

A motion was made by P. Hamilton, seconded by C. Bahnck, to approve the minutes of the June 3, 2008 as presented. The motion carried 4-0-0.

Vice-Chair D. Haubert arrived after the minutes had been approved.

 

SUBDIVISIONS: E. McArdle Major Subdivision – Preliminary/Final

TMP# 30-11-33 – Residential Zoning

Planning Module; Wynn Review dated 6/26/2008

D. Litzenberger, surveyor for the plan, as well as the applicant, E. McArdle were in attendance. D. Litzenberger brought the Planners up-to-date on the actions taken by the applicant. D. Litzenberger, S. Baluh and the Planners reviewed the Wynn Associates letter dated 6/26/2008.

#3 Will Comply: The applicant will pay a fee in-lieu-of recreation land as recommended previously by the Planners.

#4 Received: A reply has been received in April to comments in the EAC letter of October 2006.

#5 Received: An Army Corps of Engineers JD was received validating the wetland delineation on the site.

#6 Note on Plan: All lots are to be deed restricted from further subdivision.

#7 Shared Access: Lots #1 and #2 will now have separate driveways as shown on plan.

#8 Corrected: The applicant will repair/stabilize roadside swale. If road improvements are waived, a fee in-lieu-of $3,000.00 per new lot will be paid.

#10 Latest Revision: The report meets Township requirements. Because the basin exceeds three feet in depth, a split rail fence with wire backing is proposed. A maintenance agreement with the Township will be required with the owner of the lot.

#11 Approved: B.C. Conservation District approval has been received as well as the NPDES permit.

#12 Completed: Individual wells have been drilled on the lots. There are two water quality issues: one was coliform and the other was arsenic, both of which will be addressed and steps taken to rectify.

#13 Approved: Sewage Facilities Planning Module has been approved by PADEP. Sand mounds will be installed on all the lots.

#14 Complete: Property Monumentation has been installed.

#15 Will Comply: The right-of-way of Frogtown Road will be dedicated to the Township.

#16 Will Comply: Development/Financial Security Agreement will be executed between the Township and the applicant.

It was noted by the Planners and Township Engineer that everything is in order. They received preliminary approval previously and are requesting preliminary/final approval tonight. A motion was made by C. Bahnck, seconded by B. Sadow, to recommend preliminary/final approval for the E. McArdle 5-Lot Subdivision Plan conditional upon resolution of the items noted by C. Robert Wynn Assoc. letter of June 26, 2008 in a manner satisfactory to the Township. The motion carried 5-0-0.

A motion was made by D. Haubert, seconded by P. Hamilton, to recommend the following waivers for the E. McArdle Subdivision: widening of existing cartway, sidewalks and curbs. The motion carried 5-0-0.

 

LAND DEVELOPMENT: DiPalantino Land Development – Revised Plan

TMP# 30-11-83 – Easton Road – Industrial Zoning

PennDOT HOP Appl; Environmental Impact Report 5/5/2008;

Waivers 5/13/2008; Wynn Review dated 6/26/2008

Steve Jensen, of Dan Hendricks office, was in attendance. The proposed land development will consist of a garage for a paving business for D. DiPalantino. The applicant was not in attendance. This property is located on SR611 just north of the SR611/412 intersection.

S. Jensen, S. Baluh and the Planners reviewed the Wynn Associates letter of June 26, 2008.

#1 Will Comply: The applicant will increase the amount of proposed plantings around the property. A request for waiver will be sent to the Township.

#2 Will Comply: They will reply to the EAC letter of May 2008. No environmental assessment letter has been received from P-Hydro at this time. They will submit a revised narrative summary relating to non-residential uses.

#3 Clarification: S. Baluh commented that steep slopes should be noted on the plan.

Add ‘man-made slopes’

#4 Waivers: The applicant is requesting waivers for curbs and sidewalks along frontage on SR611. Curbing is proposed around the building.

#5 Will Comply: No changes are proposed at the driveway entrance. The applicant requested relief from the sight distance. The Township has requested an acceleration/deceleration lane. Would like to know why they are required to install. The Planners suggested an 8’ wide paved shoulder 100’ on either side of the driveway. Proposed improvements require a HOP from PennDOT.

#6 Will Comply: Most plants and shrubs are susceptible to deer damage. They will plant the more resilient Norway or Blue Spruce instead of white pine.

#7 Will Comply: The applicant will change the basin to a wetland basin in accordance with the PADEP manual. S. Baluh suggested that, due to the amount of crowding on the site, the applicant use some of the volume of the drainage pipes under the parking lot as storage in conjunction with the basin and make the open area of the basin smaller. S. Jensen requested using HDBE pipe. It was noted that a waiver would be required.

#8 Will Comply: The NPDES permit from the B.C. Conservation District will be applied for once the land development plans have been approved.

#9 Will Comply: The applicant will obtain a well permit once all issues have been resolved.

#10 Will Comply: A plan will be submitted to the servicing fire company for review.

#11 Will Comply: The applicant will execute an Operation & Maintenance agreement for the proposed holding tank.

#12 Will Comply: Proposed monumentation will be installed.

#13 Will Comply: Lights on the site will have break-away posts. A note will be on the plan regarding shut off lights. No motion detectors will be used due to the problem with deer. The Planners were in agreement.

#14 Will Comply: Offer the ultimate right-of-way of Route 611 to the Township for dedication.

#15 Will Comply: Development/Financial Security Agreement will be executed between the applicant and the Township.

#16 Will Comply: The Engineering/drafting details will be addressed.

The applicant will discuss the driveway issues with PennDOT and advise the Township of their final determination. The Planners took no action on the Plan.

 

NEW BUSINESS:Joint Work Session – Wednesday, July 23, 2008 @ 7:30PM

The planners discussed this scheduled work session. They will be discussing a draft of Act 537. C. Bahnck suggested that the waste haulers attend the meeting to discuss their standard practices. Contact Brad and Wayne Nicholas. D. Haubert and C. Bahnck will contact Brad and Wayne Nicholas.

C. Bahnck wanted additional information about the Bog Turtle Report. It was noted that there was no habitat to support them on the Morton property.

A motion was made by D. Haubert, seconded by P. Hamilton, to adjourn the Planning Commission meeting at 8:22PM. The motion carried 5-0-0.
