OPEN MEETING:
Chair B. Sadow opened the September 4, 2007 Planning Commission meeting with a salute to the flag at 7:35PM.
APPROVE MINUTE: A motion was made by C. Bahnck, seconded by T. Keebler, to approve the August 7, 2007 as presented. The motion carried 5-0-2 with B. Sadow and A. Santopietro abstaining, they did not attend the meeting.

Wynn Review letter of 8/29/2007
E. Tobin, attorney for the applicant, and K. Clauss, P.E. of Schlosser & Clauss were in attendance. E. Tobin, the Planners and S. Baluh reviewed the Wynn Associates letter of August 29, 2007.
1 & 2 Will Comply: Applicant will contribute a $3,000.00 fee per new building lot for a total of $30,000.00 in-lieu-of recreation land. Applicant will enter into a Well Loss Protection Agreement approved by the Township. These are conditions of preliminary approval and will be taken care of by the Township Solicitor.
3 & 4 Completed: PADEP approval of Sewage Facilities Planning Module has been verified. B.C. Conservation District approval of erosion/sedimentation plan and NPDES permit has been issued.
5, 6, & 7 Will Comply: These are conditions of preliminary plan approval. The owner of Lot #6 will be responsible for the maintenance of the proposed stormwater management facility; No further subdivision of lots; Declaration of Covenants, Easements, and Restrictions prepared in a manner satisfactory to the Township Solicitor.
8 Completed: Area within the ultimate right-of-way of Foellner Lane and Fink Drive previously dedicated to the Township.
9, 10, 11, & 12 Will Comply: The applicant will withdraw the 15-lot subdivision application in writing prior to the recording of the current subdivision plan; Land Development/Financial Security agreement executed between applicant and township; red maple trees have been removed from the plan, and plantings will be revised accordingly; add wetland plant plugs to the plan.
13 Comment: Township Environmental Consultant has revised plan for review.
14, 15 Will Comply: Property monumentation will be installed prior to recordation of plan; Plan sheets 1 thru 5 to be recorded as a set.
S. Baluh commented that there are no outstanding major concerns. J. Petersen noted that there was no response to the May EAC letter. K. Clauss and the Planners commented that this letter had been reviewed at a previous meeting, prior to preliminary plan approval. E. Tobin noted that nothing has changed since the EAC review. A motion was made by A. Santopietro to recommend that the Board of Supervisors grant final approval if a review letter is received by P-Hydro that Park View Estates address. A. Santopietro rescinded his motion.
A motion was made by A. Santopietro, seconded by C. Bahnck, to recommend that the Board of Supervisors grant final approval to the Prime Properties a.k.a. Park View Estates, 10 Lot Subdivision upon completion of the items in the Wynn Associates letter of August 29, 2007. The motion carried 7-0-0

PUBLIC COMMENT:
-B. Keyser asked for the Planner’s comments regarding the DEP drilling permit that was issued to Arbor Resources. It was the consensus of the Planner’s that they were concerned that the permit had been issued in the Residential District. S. Baluh commented that DEP does not take into account local land use rules when they issue permits, it does not determine where the well is going to be drilled. After a lengthy discussion, the Planners commented that they would support the decision of the Board of Supervisors.
-S. Mendelson is concerned, and wanted to make the Township aware, that test holes are being dug and markers have been placed on the property at Church Hill and Frogtown Roads.

A motion was made by R. Balbirer, seconded by T. Keebler, to recommend upon satisfactory receipt from Sal Lapio Homes (Harrow Manor) and Wehrung Phase II Land Development that the Board of Supervisors grant an extension.
The motion carried 7-0-0.
-C. Bahnck wanted clarification regarding the continuation of the Hanson Quarry hearing. S. Baluh commented that the hearing has not been closed it will be continued at a later date.
-S. Baluh commented that he brought in Flexible Development plans from another municipality for the Planners to review. He will send copies to the Planners.
A joint work session is scheduled for September 10, 2007 at 7:30PM to discuss the proposed Groundwater Ordinance.
ADJOURNMENT:
A motion was made by R. Balbirer, seconded by A. Santopietro, to adjourn the Planning Commission meeting at 9:10 PM. The motion carried 7-0-0.
