MINUTES - October 2, 2007

OPEN MEETING:
Chair B. Sadow opened the October 2, 2007 Planning Commission meeting with a salute to the flag at 7:35PM.

APPROVE MINUTE: A motion was made by T. Keebler, seconded by A. Santopietro, to approve the September 4, 2007 with the following correction: Chair B. Sadow opened the September meeting. The motion carried 7-0-0.

LAND DEVELOPMENT: None
 
NEW BUSINESS:           Change November 6, 2007 Meeting Date –
A motion was made by R. Balbirer, seconded by M. Kulp, to direct the Secretary to advertise the change to the November Planning Commission Meeting to Wednesday, November 7, 2007 at 7:30 PM due to Election Day. The motion carried 7-0-0.

                        Cobbler Road, LLP, 3-Lot SD – TMP# 30-11-105
H. Sudfeld, Attorney for the applicant, S. Mill, VanCleef Engineering, engineer for the project and the applicant, R. Harrington, were in attendance. H. Sudfeld commented that the original plan has been reviewed and revised from 13-Lots, originally submitted in July 2005, to three (3) lots. It was noted that, after reviewing the letter received from the Township Engineer, several variances would have been required for the community sewage plant and the stream crossing. The 3-lot sketch plan that was submitted by the applicant shows a single shared driveway, B-1 Cluster zoning provides for on-lot sewage systems and wells. The stream crossing will require a large pipe rather than a box culvert. R. Harrington is seeking direction from the Planners. S. Baluh commented that we are dealing with the same issues whether it is a street or a road and that the stream crossing is a zoning issue and would also require a PADEP permit. He recommended pre-cast arches which would not disturb the stream bed, change the flood plain and disturb the 100-year flow. They cannot change the flood plain or disturb the 100-year flow. Several concerns were voiced by the EAC including but not limited to: a 28’ pull- off area for two-way traffic, plan should reflect the woodlands, the installation of sidewalks (not warranted), and more stringent well testing due to the previous use of the land. Phase I testing was completed and nothing out of the ordinary was found. The Planners commented that they are not in favor of shared driveways. They requested that the applicant revise the print to show three independent drives after a single (18’) stream crossing. They also recommended a letter to remove the 13-lot plan prior to approving the 3-lot plan, a level gravel pull-off area after the stream crossing, a concrete arch for the stream crossing, paving of the individual driveways and the cartway, protect the steep slopes and wooded area, a note on the deed regarding the active shooting range. The applicant will take these recommendations under advisement.

OLD BUSINESS:           Meeting date for Joint Work Session
The Planners commented that another Joint Work Session should be scheduled to discuss Zoning Ordinances, Act 537 and the Flexible Development Ordinance. The Planners recommended that the BOS advertise a Joint Work Session to be held on October 29, 2007 @7:30PM to discuss Act 537 and the Flexible Development Ordinance.
 
PUBLIC COMMENT:
-B. Keyser noted that the retention basin at the Beaver Run Road Subdivision is only 25’ from the house foundation being constructed. S. Baluh commented that the Township does not regulate where basins are positioned. However, depending on field conditions, it could be moved. B. Sadow commented that a minimum distance of 50’-75’ could be required by the Township. S. Baluh noted that a dimension could be shown on the plan.
-S. Stone asked S. Baluh if the property owner on Kintner Ridge knows how to maintain the large retention basin and can information be sent to the home owner explaining the maintenance procedures? Currently it is only being mowed. He also wanted to know the status of Beres Construction. S. Baluh commented that the builder is currently being reorganized. Escrow money from the Letter of Credit will be used for final paving of the road, the driveway entrances, and clean-up of the rear basin. He noted that the finish work may have to wait for spring.
-K. Schneider read a letter to the Planners regarding Palisades High School and the problems they have experienced with loss of well water. He requested that the Township be aware of how additional housing will affect the aquifers. It was noted that there are no records showing water levels from previous years. T. Stone commented that he and Dr. Stanfield have spoken with school officials and that a well monitor is being considered. B. Keyser requested that Bucks Country Nursery install a well monitor and send data to the Township. J. Fritz has a well-monitor, but no data has been received by the Township. M. Kulp commented that the Board of Supervisors should designate someone to keep records of well monitor reports, whether it is one person or a committee. A motion was made by M. Kulp, seconded by A. Santopietro, that the PC forward a recommendation to the BOS that the facilities in the Township that have been required to install a water consumption monitor send their information to a point to be designated by the Board of Supervisors.

A motion was made by A. Santopietro, seconded by M. Kulp, to recommend conditional denial to the E. McArdle Subdivision if the Board of Supervisors has not received an extension by the October 2007 meeting. The motion carried 7-0-0.
-B. Keyser suggested that the Board of Supervisors does not want to see a plan from Cobbler Road, LLP unless better testing is done for the soils and water.

ADJOURNMENT:
A motion was made by A. Santopietro, seconded by T. Keebler, to adjourn the Planning Commission meeting at 8:55 PM. The motion carried 7-0-0.
