OPEN MEETING:
Chair B. Sadow opened the May 2, 2006 Planning Commission with a salute to the flag at 7:35 PM .
APPROVAL OF MINUTES:
A motion was made by C. Bahnck, seconded by T. Keebler, to approve the minutes of the April 4, 2006 minutes as presented. The motion carried 3-0-3 with D. Haubert, M. Kulp, and A. Santopietro abstaining.
CONDITIONAL USE: New Cingular Wireless PCS, LLC
TMP# 30-10-34-2 – 92 Tower Road
Alterations to Tower Wynn Review Letter – 4-27-06
Chris Schubert of Riley, Riper, Hollin & Colagreco, attorney for the applicant, was in attendance and will be representing Cingular Wireless at the May 18, 2006 public hearing. He noted that three additional antennas will be installed on the existing tower in addition to upgrading site equipment. Nine antennas will be replaced with twelve. A motion was made by C. Bahnck, seconded by A. Santopietro, to recommend that the BOS grant conditional approval to the upgrades for the Tower at 92 Tower Road owned by American Tower Corp. which includes updating the radios and the addition of three new antennae. The motion carried 6-0-0
SUBDIVISIONS: Curtis & Lynn DeAngelis , 2-Lot Subdivision
Revised Preliminary, Zoning Residential/Agricultural
TMP# 30-4-47-4 – 37 Traugers Crossing Road - Wynn Review Letter – 4-26-06
E. Pelligrino, Urwiler & Walter, presented the revised preliminary plan. L. DeAngelis was also in attendance. He commented that the applicant wants to add a driveway easement to the plan that would cross over Lot # 1. B. Sadow voiced concerns about damage that may occur to the lines under the driveway and does not want to start a trend. When asked, S. Baluh commented that the driveway works in either location. The Planning Commission had approved the prior plan, and would now be amending that recommendation. A motion was made by T. Keebler, seconded by D. Haubert, to have the plan revert back to the original right-of-way (plan). The motion carried 5-1-0 with M. Kulp voting nay.
Edward McArdle, Jr, 5-Lot Subdivision
Revised Preliminary, Zoning Residential TMP# 30-11-33
BCPC/BCCD Review Letters not received - Wynn Review Letter – 4-25-06
D. Litzenberger, surveyor for the project, presented the revised plan to the Planning Commission. E. McArdle was also in attendance. There has been no response from the B.C. Planning Commission and B.C. Conservation District. D. Litzenberger and the Planners reviewed the Wynn Associates Letter of April 25, 2006.
2. Will Comply: The Riparian corridor that goes through Lot #5 needs to be addressed. A summary should be included on the plan for the overall restrictions.
3. Recreation land not proposed. Township should determine if fee in-lieu-of is appropriate due to the configuration of the land.
4. Awaiting a response from EAC and P-hydro regarding the Narrative Summary.
5. Will Comply: The delineation report from NOVA Consultants, LTD must be validated by the A.C. of Engineers. A full report is needed.
6. Will Comply: A note has been added to deed restrict all the lots from further subdivision. This should be accomplished in a manner satisfactory to the Township Solicitor.
7. Will Comply: Engineering comments A thru F should be addressed by the applicant.
8. Will Comply: Applicant will improve the roadside swale by regarding, stabilizing the erosion with control matting and seeding. If remaining waivers are granted, a fee in-lieu-of $3,000.00 per new building lot will be required.
9. Will Comply: Trees along the right-of-way of Frogtown Road . Replacement trees should be proposed where grading will occur on Lot #3.
10A thru L - Will Comply: Township Engineer seeking additional detail in the Stormwater Management Narrative Report. Steve will meet with the consultant for the applicant.
11, 12, 13, 14, 15 Will Comply: Awaiting written approval from the BCCD; well permits will be obtained from the Township; sand mound systems are proposed for all lots, BCDH will determine if replacement of existing system is required; property monumentation to be installed; area within the ultimate right-of-way of Frogtown Road to be dedicated to the Township.
16. Will Comply: Development/Financial Security Agreement to be executed between the applicant and the Township. “Opinion of Cost” will be prepared by the design engineer and submitted for review and agreement preparation.
17A thru F. Will Comply: Engineering/drafting detail comments to be addressed on the plan.
The maintenance of the Lot #3 detention basin will be the responsibility of the lot owner. The Planners took no action on the plan. S. Baluh requested an extension letter for this subdivision.
LAND DEVELOPMENT: None
NEW BUSINESS: None
OLD BUSINESS: Wehrung’s – Route 611
TMP# 30-10-35-1
Seeking direction from Planners to complete
the Land Development in phases.
E. Pellegrino, from Urwiler & Walter, presented the information concerning proposed phasing of this Land Development to the Planners . V. Wehrung was also in attendance. Many delays have been encountered with PennDOT regarding changes to SR611. The applicant would like to complete the expansion of the existing building and driveway. The additional warehouse space will require an increase of employees to three but there would be no increase in truck traffic. Also being considered is a millwork area, which the Planners noted would require Conditional Use approval. The Zoning Officer should be contacted to begin this process. E. Pellegrino explained that the first phase would consist of driveway extensions toward the rear of the existing building, the increased storage area and a revised stormwater management plan. It was the consensus of the Planners that the applicant present new drawings showing the phases of construction along with revised stormwater calculations.
S. Baluh commented that the Planners had recommended conditional preliminary approval, since this plan has not been before the Board of Supervisors. He further stated that a preliminary plan showing Phase I be presented for Township approval and come back later for final plan approval for the other phases.
PUBLIC COMMENT:
S. Donovan commented that a second educational forum will be held at Palisades High School , Wednesday, May 10, 2006 .
C. McClosky inquired if additional plans have been submitted to the Township and noted that representatives for Sal Lapio have visited the site with regard to the berm that will be installed next to their property.
S. Mendelsohn attended a Regional EAC meeting that was very informative and highly recommended that everyone attend the September meeting.
