MINUTES
April 4, 2006

OPEN MEETING:
Chair B. Sadow opened the March 7, 2006 Planning Commission with a salute to the flag at 7:30 PM .

APPROVAL OF MINUTES:
A motion was made by D. Haubert, seconded by T. Keebler, to approve the minutes of the February 7, 2006 minutes as amended on Page 3. The motion carried 4-0-1 with R. Balbirer abstaining.

SUBDIVISIONS: None

LAND DEVELOPMENT: None

 NEW BUSINESS:Municipal Ordinance Review Project
Lower Delaware River Corridor
In January, T. Stone requested that this information be forwarded to the Township Engineer and the Planners . S. Baluh commented that this is a follow-up to a prior study which collated all the ordinance and environmental protection issues in ordinances enacted by townships along the Lower Delaware River Corridor over the past five years. A copy was given to the EAC for review and, if needed, will be addressed at a later time. No action was taken by the Planners .

Planning Module for Edward J. Litzenberger Subdivision
Route 611 – TMP# 30-11-196
S. Baluh commented that this three-lot subdivision on SR611 was approved in November 2003 with an existing house and septic system on Lot #1 and was originally a rural residency exemption. The Township had been awaiting the replacement of this septic system. The B.C. Department of Health forwarded the Planning Modules to the Township for approval. This module is based on the ordinances in affect at the time, and is the only outstanding item on the plan. Signatures are required in order to forward to the DEP for approval and then recording of the plan. A motion was made by R. Balbirer, seconded by C. Bahnck, to have the Planning Commission Chairman, B. Sadow, sign the Planning Module for the E. Litzenberger three-lot Subdivision, TMP# 30-11-196. The motion carried 5-0-0.

Draft of Park & Recreation Plan
Forward comments to Park & Rec Board by 3/24/06

B. Sadow commented that the Park & Rec Board requested that the Planners review the draft of the Park & Recreation Plan and submit comments by Friday, March 24, 2006 . All comments will be returned to the Township office and forwarded. C. Bahnck reviewed some of this document and wanted to know the priority issues. T. Keebler commented that on the parcel on SR611, Revere Chemical Site, Park & Rec is considering the following: moving the cap fence to encompass the cap only, and building ball fields and walking trails. R. Balbirer wanted to know if an ice skating rink is proposed for any of the areas. None is planned at this time. D. Haubert commented that changes will be made to the draft from comments received from the Planners . It will then be forwarded to the Board of Supervisors.

Planner Input – Keep correspondence on agenda
The Planners discussed the amount of correspondence that is received every month and placed on the agenda for there meetings. In order to keep this to a minimum a suggestion was made to consolidate in the form of a memo. The Planners will advise the Secretary of their decision.

OLD BUSINESS:New PADEP Rules for Animal Management
R. Balbirer brought this information to the attention of the Planners at the December 2005 meeting. These are new State and Federal Regulations concerning nutrient management for farms, a copy of which was given to the Planners . He further explained how this would impact farmers and agriculture.

PUBLIC COMMENT:
-B. Davis commented that he is planning to open a gift shop/country store at 8826 Easton Road and wanted to know if the Planners objected to the construction of an additional driveway at that site. S. Baluh commented that after speaking with B. Davis this should be resolved with PennDOT. The curve near his property may prohibit him from obtaining a permit. A letter of support will be needed from the Township in order to move forward with this project. A motion was made by R. Balbirer, seconded by D. Haubert, to grant Mr. Davis a letter of support for a second driveway at TMP# 30-11-129 based on the condition of written approval from PennDOT. The motion carried 5-0-0.

S. Baluh commented that there are several plans that need extensions and requested that the Planners make a conditional denial if none are received for the following: Lake Warren 7-Lot subdivision on the same tract as the approved Sal Lapio 15-lot subdivision. The condition in the approval letter states that Sal Lapio has to withdraw the application for the 7-lot before final approval of the 15-lot plan. It will remain on the list until a letter is received from Sal Lapio. Other plans requiring extensions are: Wehrung Group Land Development, they are currently working with PennDOT; Brill Subdivision; Gartner Building Group Land Development, and Glazier/Prime Properties.

A motion was made by R. Balbirer, seconded by T. Keebler, based on the March 6, 2006 Wynn Assoc Sub/Land Development letter for pending approvals and subdivisions to give conditional denial of subdivision plans unless a request in writing is received for an extension for the following: Lake Warren Partnership (Tabor Road); Wehrung Group Land Development; Brill Subdivision; Gartner Bldg Group Land Development and Glazier/Prime Properties Subdivision. The motion carried 5-0-0.

R. Balbirer commented about the property on SR412 and Park Drive East requesting a tennis court and the repair to their septic system. He believes that an amendment should be in the Zoning Ordinance and suggested that Steve write up an amendment reflecting this problem. B. Sadow added that the repair wasn’t for the tennis court it just happened that they both coincided. The homeowner came to the BOS seeking an Operation & Maintenance agreement with the Township for an a/b repair. S. Baluh commented that project fell into middle ground because they were consolidating property and building a tennis court, which required a stormwater management plan, and an issue arose with the B.C. Dept. of Health for the septic. Township does not look at septic issues for lot consolidation. S. Baluh commented that he will talk to T.J. with regard to changing the definition of a subdivision or land development in the ordinance that would specifically address the consolidation issue and clarify when a plan is or isn’t required. If no additional improvements are planned and a lot next door is purchased to combine on the deed, he agrees that extra work is not required to have a plan prepared to accomplish that end. S. Baluh noted that T.J. will report to the Board with his recommendations.

B. Sadow referred to the correspondence received for the month.

A motion was made by R. Balbirer, seconded by T. Keebler, to adjourn the Planning Commission meeting at 8:10 PM . The motion carried 5-0-0.
