Governor Rendell signed the "Diesel Power Motor Vehicle Idling Act (SB295)" in October, 2008, with an effective date of February 9, 2009.
After that date, idling of diesel vehicles with a gross vehicle weight rating (GVWR) of 10,001 pounds or more is limited to no more than five minutes each hour.
However, exemptions were included to address township concerns regarding this matter. These include:
- Vehicles while actively loading or unloading. (The vehicle may idle for up to 15 minutes.)
- Emergency and utility service vehicles (being used in an emergency or public safety capacity)
- Vehicles experiencing mechanical difficulties beyond operator's control
- Vehicles forced to idle due to on-highway traffic or traffic control devices
- Vehicles idling necessary for repair/maintenance or diagnostic testing
- Vehicle idling as required by federal and state inspections
- Vehicle idling necessary as part of a security inspection either entering or exiting a facility
- A vehicle that is actively engaged in solid waste collection or the collection of source-separated recycling materials.
