NOTICE

NOTICE IS HEREBY GIVEN that the Nockamixon Township Zoning Hearing Board will conduct a public hearing on April 17, 2008 at 7:00 PM at the Nockamixon Township Building, 589 Lake Warren Road, Ferndale, PA to consider the application of Hanson Aggre- gates BMC, Inc. filed under the provisions of the Second Class Township Code, 53 P.S. 65101 et seq., Section 909.1(a)(2) of the Municipalities Planning Code, 53 P.S.
10909.1(a)(2), and the Pennsylvania Supreme Court decision in Glen Gery Corp. vs. Zoning Hearing Board of Dover Township, 589 Pa. 135, 907 A.2d 1033 (2006). This application is a procedural challenge to the validity of the Nockamixon Township Zoning Ordinances. The applicant is the owner of approximately 103.5 acres on Quarry and Easton Roads in Nockamixon Township, consisting of TMP #30-011-101 which presently is used as a quarry and #TMP #30-011-100 which is presently vacant. If this challenge is successful, the applicant intends to use both properties as and for a quarry. The Township Ordinances which are attacked by this challenge are the following:

(1)
Ordinance No. 18 enacted on September 30, 1968, known as the 1968 Zoning Ordinance;

(2) Ordinance No. 35 enacted on December 11, 1984, known as the "Quarry Ordinance";

(3) Ordinance No. 56 enacted on December 27, 1989, known as the "1990 Zoning Ordinance"; and (4) Ordinance No. 101 enacted on January 9, 2001, known as the "2001 Ordin-ance Codification". Interested persons are invited to attend this hearing and to examine the application and its related documents at the Nockamixon Township Building, 589 Lake Warren Road, Ferndale, PA during normal business hours.

Kintner Hill and Route 611 - Easton Road

Construction to begin in early spring, 9 am until 3pm. Construction is expected to finish by August 25, 2008.
