Chair B. Sadow opened the April 6, 2010 Planning Commission with a salute to the flag at 7:30 PM.

 

APPROVAL OF MINUTES:

A motion was made by M. Kulp, seconded by J. Petersen, to approve the minutes of the March 2, 2010 PC meeting as presented. The motion carried 7-0-0.

 

SUBDIVISIONS : Patricia & John Gouck, 2-Lot Subdivision – Final

BCPC letter 3/22/2010 – Response to P-Hydro 3/3/2010

BCCD letter of Adequacy 3/24/2010

 

Paul Dietz presented for the applicant, Patricia Gouck, who was also present. Mr. Dietz stated that the well has been drilled and tested. He reviewed the 3/30/2010 Township Engineer’s review letter.

#1 Will Comply : fee in lieu of dedication of recreation land.

#2 Will Comply : fee in lieu of road improvements.

#3 Will Comply : comment from Township environmental consultant regarding final plan submission.

#4 Will Comply : Storm Water Management and erosion.

#5 Will Comply : Bucks County Conservation District approval.

#6 Will Comply : water quality and pump yield reports submittals. Well has been drilled and tested.

#7 Will Comply : Sewage Facilities Planning Module, DEP has approved.

#8 Will Comply : Driveway entrance revision – neighbor has been notified.

#9 Forthcoming : Development/Financial Security Agreement.

 

A motion was made by D. Haubert, seconded by P. Temples, for final approval on the Patricia and John Gouck 2-lot subdivision based on the items listed in the 3/30/2010 Township Engineer’s review letter and the changes discussed this evening. The motion carried 7-0-0.

 

LAND DEVELOPMENT:None

 

NEW BUSINESS: None

 

OLD BUSINESS: Proposed revision of ACT 537 update. The proposed changes discussed in response to the BCPC letter include: the township will not get involved in specific sewage system inspection procedures, amend sample agreements, add checklist without a reporting requirement, S. Baluh will see if there are any DEP factsheets to add as additional information; the general consensus is that the Commission is still investigating the extent of riparian buffer regulations so it is not able to make specific riparian buffer requirements in the Act 537 Plan at this time; in regards to holding tank replacement, the township has a program in place to require fill sites on non residential properties; and additional text will be added to support basis for hierarchy of system types.

S. Baluh explained that the after the adjustments are made to the Act 537 Plan and a written response to the BCPC letter is prepared, an amended draft of the Act 537 plan will be sent to the Board of Supervisors, who will then authorize advertisement for a 30 day public comment period. If any written comments are received, the Township needs to respond. After the 30 day public comment period, there is an advertised public hearing by the BOS, then the BOS can adopt the Act 537 plan. It then gets sent to the DEP for review, and the PC will have the opportunity to review the DEP’s comments.

 

A motion was made by M. Kulp, seconded by C. Hall, to recommend endorsement and forwarding of the current draft copy of the Act 537 plan along with review and responses from the 12/2/2009 Bucks County Planning Commission letter, and the 3/22/20210 Bucks County Health Department letter, and the comments from the Township Engineer. The Commission also suggested amending the Zoning ordinance to expand the requirement for secondary septic system sites to include a secondary site to be identified on all lots within subdivisions. The motion carried 7-0-0.
