BOARD OF SUPERVISORS -- JOINT WORK SESSION

THURSDAY, JUNE 24, 2010

A Joint Work Session of the Nockamixon Township Board of Supervisors, Planning Commission and Environmental Advisory Council was held Thursday, June 24, 2010 at 7:30 PM at the Township Building in Ferndale, PA. Chairperson Nancy C. Janyszeski opened the meeting with a salute to the flag. Other members present were Vice-Chairperson Bruce Keyser, and Supervisors Carl Bahnck and William Sadow, Jr. - Members absent: Albert Santopietro. Planning Commission members present: Mark Kulp. EAC members present: Co-Chair Steven Donovan and members Sanci Tenney, Patricia Keyser, Alana Balogh and Sharon Mendelson. Todd Stone arrived at 8:00 PM. Princeton-Hydro Vice-President, Mark Gallagher, gave the presentation. Resident attendees: Marvin and Arlene Eichlin. This Work Session was advertised in the Intelligencer on Friday, January 15, 2010.

-- Jerry Harold Minor Subdivision TMP# 30-3-9 – grants six-month extension to January 19, 2011. The applicant, J. Harold, and his Attorney, R. Isgate, were in attendance. N. Janyszeski referred to the conditions in the letter from Clemons dated 7/26/05. It was noted that Township Engineer, S. Baluh, requested that the applicant replenish the professional escrow to cover final costs. A motion was made by C. Bahnck, seconded by Wm. Sadow, Jr., to grant a six-month extension to January 19, 2011 for the Jerry Harold Minor Subdivision TMP# 30-3-9. The motion carried 4-0-0. The applicant agreed to the items in the Clemons letter and to pay additional escrow.

--Riparian Buffer Presentation – Mark Gallagher, Vice President, Princeton-Hydro.

His presentation consisted of definitions for Riparian buffers, why they are regulated and examples of how other regulatory bodies have regulated these resources. They are a band of land, broad or narrow, upland of a stream or river. They help maintain existing resources and corridors and are still healthy in Nockamixon Township. Studies show that ideal buffers are broader and shallower rather than narrow and deeper, this fosters more nutrient settlement. He noted that Harrisburg is considering amending Act 102 regarding definitions/requirements for Exceptional Value and High Quality Riparian Buffers.

--Chair, N. Janyszeski commented that from 7:15 P.M. to 7:30 P.M the Board met in Executive Session to discuss Real Estate.

--The meeting continued with Suggested Discussion Topics – Joint BOS/EAC Work Session.

-Hidden Valley - Remediation; formal walk about - There is no additional information available from Bucks County for Hidden Valley at this time. --Hanson Quarry – Permit, remediation, apparent stone/mud slide on and outside berm facing 611 - The Board will look into the apparent stone/mud slide and discuss with the Solicitor. The Board had no further comment due to current litigation. --Revere Chemical/Rapp Creek Park – No planned activities; --Cabot – No activity; --Oil & Gas – In litigation; --Harrow Senior Housing – 55+ - land development in process; --Bickel Dump – EAC walked the stream recently, they noted that additional items have surfaced on the property. Wm. Sadow suggested that the EAC keep the Board apprised of their concerns. They can also contact the Zoning Officer.--Subdivision Reviews: The Board and OSC discussed subdivision reviews and extensions that have been granted. M. Gallagher commented that new state regulations may impact in-progress subdivision plans.--Water Ordinance: No new subdivisions have been submitted since the enactment of the new Water Ordinance. It was noted that well testing results have been received by the Township for new residences. S. Donovan would like Board approval to review the well data and set up a database. B. Sadow commented that S. Baluh will be contacted for his input.-- BNT GWMC Re-survey of wells – the continuation of the 2009 project. The goal is to understand the changing standing well water level in the Township and to pinpoint areas of concern. The Board took no action on the re-survey.

A motion was made by N. Janyszeski, seconded by Wm. Sadow, to adjourn the meeting at 9:50 P.M. The motion carried 4-0-0.
